Fritt fram att fildela!

För någon vecka sedan beslutade HD att skicka första Ipred-fallet till EUs domstol. Detta innebär nu enligt flera jusrister att det blir så gott som fritt fram att fildela. Det kan ta EU-domstolen ett par år att besluta i ärendet och i bästa fall upp till 5 år. :)

Det blir i praktiken riskfritt att fildela de närmaste åren.
Högsta domstolens besked i förra veckan betyder att fildelarnas identiteter är helt skyddade tills vidare, enligt flera jurister.

Fildelning är förbjuden men brottet är inte så allvarligt att polisen har rätt att göra husrannsakan om det är i liten skala, till exempel om någon laddar hem några filmer eller låtar då och då.

Men de småskaliga fildelarna har ändå inte kunnat känna sig helt säkra. Ipredlagen betyder att rättighetsinnehavarna har möjlighet att gå till domstol och kräva ut identiteten bakom ett misstänkt ip-nummer.

Kristoffer Schollin, doktor i immaterialrätt i Göteborg och expertvittne i Pirate Bay-rättegången, bedömer att medan EU-domstolen ruvar på målet kommer inga andra beslut att tas i svenska domstolar om informationsförelägganden.

Det betyder att fildelare kommer att vara skyddade om skivbolag eller filmbolag kräver ut identitetsuppgifter, tills EU-domstolen sätter ner foten.-De andra processerna i tingsrätt och hovrätt där rättshavare har begärt att internetleverantörer ska lämna ut sådana uppgifter kommer alltså också att förklaras vilande, allt i väntan på att Högsta domstolen får sina frågor besvarade och kan avgöra i Ephone-målet, säger Schollin.

Det gäller också de två andra mål om informationsförelägganden som redan dragit igång. Det handlar om Telia och Comhem som också valt att inte lämna ut kunduppgifterna till ett antal filmbolag respektive skivbolagens rättighetsorganisation Ifpi.

IT-rättsjuristen Daniel Westman vid Stockholms universitet gör samma bedömning som Schollin.

Det finns dock EN som inte håller med och det är Henrik Pontén i Antipiratbyrån:

-Det har aldrig varit riskfritt att fildela illegalt och det blir det inte nu heller. Det här innebär att ett av våra verktyg för tillfället inte kan användas. Men det betyder också att kulturskaparna inte är lika skyddade i Sverige som i övriga världen, säger Pontén.

Nästa vecka börjar Pirate Bay-målet i Hovrätten.

Artister tjänar bättre trots pirater

Skivbolagen blöder, omsättningen har rasat under 2000-talet medan fildelningen växt. Men artisterna har klarat sig betydligt bättre.
Två forskare på Kungliga tekniska högskolan (KTH) gjorde i våras en kartläggning av den svenska musikbranschens intäkter sedan 2000. Det gällde skivbolag, promotionbolag som ordnar livespelningar, och organisationer som Sami, som kanaliserar pengar till artisterna.
Och under det senaste decenniet har artisternas intäkter växt kraftigt, från omkring 800 miljoner kronor till 1 200 miljoner 2008. Ökningen beror främst på att intäkter för livespelningar i grova tal fördubblats.
Men forskningsrapporten går inte in på utfallet för enskilda artister eller hur olika musikstilar påverkats.
